more recently, mediation clauses appear in contracts for construction
and real estate transactions. Notwithstanding the typical standardized
contractual arrangements, the possibilities for dispute resolution
are much more varied than these rigidly-defined processes.

KGA's intermediary
services are customized to the needs of the particular dispute
and the parties involved. A dispute resolution process may include
the following:
• Initial contact
between all parties to gain a commitment to attempt to reach
a solution
• Individual and confidential assessment of each party's
position
• Development of a group consensus regarding the process
for working towards a solution
• KGA facilitator chaired meeting of the parties involved
• Drafting of an agreement with procedures for resolving
downstream disputes
• Implementation of agreement with follow-up to resolve
unforeseen disputes or claims
